1. What information do we collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Website or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Website, the choices you make and the products and features you use. The personal information we collect may include the following:

Personal Information Provided by You. We collect names; phone numbers; email addresses; mailing addresses; job titles; company names; and other similar information. If you apply for a job, we also collect your resume and what it contains (see “Job applicants” below).

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our Website.

We automatically collect certain information when you visit, use or navigate the Website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Website and other technical information. This information is primarily needed to maintain the security and operation of our Website, for our internal analytics and reporting purposes, and, through ZoomInfo, to recognize which company a visit may come from (see section 4).

The information we collect includes:

Log and Usage Data. Log and usage data is service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our Website and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity in the Website (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings).

Device Data. We collect device data such as information about your computer, phone, tablet or other device you use to access the Website. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model Internet service provider and/or mobile carrier, operating system and system configuration information.

Location Data. We collect approximate location, such as your city, region, or country, which Google Analytics and ZoomInfo infer from your IP address. We do not collect precise location from your device.

Job applicants

If you apply for a job through our careers page, we collect your name, email address, and phone number; the position you are interested in; your location and LinkedIn profile if you give them; the resume you upload and everything in it, such as your work history, education, and qualifications; and anything else you choose to tell us.

We use this information to consider you for roles, to contact you about your application, and to meet our legal obligations as an employer. It goes to the POWERS hiring team and to the service providers that host our Website and its forms. We do not sell it or share it for advertising, and ZoomInfo does not run on our careers page. How long we keep it is explained in section 5, and your rights over it in section 8.

2. How do we use your information?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Website for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

• To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
• To protect our Services. We may use your information as part of our efforts to keep our Website safe and secure (for example, for fraud monitoring and prevention).
• To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract.
• To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
• To deliver and facilitate delivery of services to the user. We may use your information to provide you with the requested service.
• To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
• To consider job applications. If you apply for a job, we use your information to evaluate you for roles, to contact you about your application, and to meet our legal obligations as an employer.
• To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. For example, when expressing an interest in obtaining information about us or our Website, subscribing to marketing or otherwise contacting us, we will collect personal information from you. You can opt-out of our marketing emails at any time (see the “What are your privacy rights?” below).
• To understand which organizations visit our Website. We use ZoomInfo to recognize which companies visit, so our team knows which organizations and industries are paying attention. ZoomInfo may also use what it collects for its own purposes, as section 4 explains, and you can opt out at any time.
• For other business purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Website, products, marketing and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information.

3. Will your information be shared with anyone?

In Short: We share information with your consent, with the service providers that run our Website and business, with ZoomInfo as described in section 4 unless you opt out, to comply with laws, to protect your rights, or in a business transfer.

We may process or share your data that we hold based on the following legal basis:

• Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.
• Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.
• Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.
• Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
• Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

Service Providers. We share information with companies that perform services for us, such as hosting our Website and its forms (WP Engine), delivering email, measuring traffic (Google Analytics), and serving our web fonts (Adobe Fonts). They may use it only to provide those services to us.

ZoomInfo. Unless you opt out, the ZoomInfo tag on our Website receives your IP address and the pages you view. ZoomInfo may use this information for its own purposes, which California law may treat as selling or sharing personal information. Section 4 explains how to opt out, and section 10 covers your California rights.

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

4. Do we use cookies and other tracking technologies?

In Short: Yes. Outside Europe, our measurement and visitor-identification tools run by default, and you can switch them off at any time through Preferences on our banner or the Your Privacy Choices link in the footer. If you visit from Europe, or your browser sends a Global Privacy Control signal, they stay off unless you turn them on.

Your choices

When you first visit the Website, a banner names the tools we use and offers two choices: OK or Preferences. Preferences opens Your Privacy Choices, where Opt out of all switches every optional tool off at once, or you can switch each tool on or off on its own. If you ignore the banner, the tools stay on. You can change your choice at any time through the Your Privacy Choices link in the footer of every page.

If your device is set to a European time zone, which we use as a stand-in for visiting from the European Union, the United Kingdom, or Switzerland, you see a consent banner instead: Accept, Decline, or Preferences. Optional tools then stay off until you say yes, and they stay off if you ignore the banner.

If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of every optional tool, including anything that could count as selling or sharing your personal information, and the banner tells you the signal was honored (see section 9).

Your choice is stored in your browser (in localStorage, under the key powers_consent_v1) and is never sent to any server. An opt-out is remembered until you change it or clear your browser’s storage. If you keep the tools on, we show the banner again after twelve months. Switching a tool off stops its tracking and deletes the cookies it set on our domain. A small number of vendor cookies live on the vendor’s own domain; we cannot delete those for you, and they can only be removed in your browser settings.

Strictly necessary storage (always on)

The privacy choice itself (powers_consent_v1, described above) and a small entry that remembers your recent site searches live in your browser’s local storage. They identify no one and go no further than this site. Our hosting provider may set cookies strictly necessary to serve and protect the Website, such as security and load-balancing checks. Our pages also load the Proxima Nova typeface from Adobe Fonts, which Adobe’s license requires serving from Adobe’s network; Adobe states this service does not use cookies. All other fonts are served directly from our own site.

If we add a tracking tool in the future, it will appear here and in the banner before it runs. If you have opted out of any tool, a new one stays off for you until you switch it on.

5. How long do we keep your information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). How long that is depends on the information:

• Inquiries and contact details you send us: for as long as we are handling your inquiry, and afterwards for as long as we have a business relationship with you or your organization.
• Job applications: for as long as we are considering you for a role, plus the period employment-records laws require us to keep application records (generally at least one year). If we hire you, your application becomes part of your employee file.
• Google Analytics: the underlying event data is kept for no more than 14 months. Its cookies stay in your browser for up to 2 years unless you opt out or clear them.
• ZoomInfo: its cookie and session entries stay in your browser until you opt out or clear them. ZoomInfo keeps what it collects under its own privacy policy.
• Server logs: kept by our hosting provider only as long as needed to keep the Website secure and working.
• Your privacy choice: stored in your browser, as described in section 4.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. How do we keep your information safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk. You should only access the Website within a secure environment.

7. Do we collect information from minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly solicit data from or market to children under 18 years of age. By using the Website, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Website. If we learn that personal information from users less than 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records. 8. What are your privacy rights?

In Short: Depending on where you live, you may have the right to access, correct, delete, or take a copy of your personal information, and to opt out of its sale or sharing. We offer these rights to everyone, including business contacts and job applicants.

California, Colorado, Connecticut, Texas, Virginia, and a number of other U.S. states give their residents rights over their personal information. Rather than sort requests by where you live, we offer the same rights to everyone:

• Access. Ask whether we process your personal information, and get a copy of it, in a portable format where that is technically feasible.
• Correction. Ask us to correct personal information about you that is inaccurate or incomplete.
• Deletion. Ask us to delete personal information about you, subject to the exceptions the law allows.
• Opt out. Opt out of the sale or sharing of your personal information. On our Website, the Your Privacy Choices link in the footer and Global Privacy Control signals do this for you (see sections 4 and 9). We do not use your personal information for targeted advertising ourselves, or to make automated decisions that have legal or similarly significant effects on you.
• Appeal. Ask us to reconsider if we decline your request (see below).
• Non-discrimination. We will not treat you differently for exercising any of these rights.

How to make a request. Email us at info@thepowerscompany.com with “Privacy request” in the subject line, or call us at +1 678-971-4711, and tell us what you would like us to do. Before we act on a request to access, correct, or delete, we will verify your identity, usually by matching details you give us with information we already hold. You may use an authorized agent, and we may ask for proof that they are authorized to act for you. We respond within 45 days. If we need more time, we will tell you why, and we may extend that once by up to another 45 days.

Appeals. If we decline to act on your request, you can appeal by replying to our decision with “Appeal” in the subject line. We will respond within 45 days and explain what we decided and why. If we deny your appeal, you can contact the attorney general of your state.

If you are a resident in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. 9. Controls for do-not-track and opt-out preference signals

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized, so we do not respond to DNT signals on their own.

We do honor Global Privacy Control (“GPC”), the opt-out preference signal recognized by California and a number of other states. If your browser or a browser extension sends a GPC signal, we treat it as a valid request to opt out of the sale or sharing of your personal information and of every optional tracking tool on this Website. Those tools stay off, and our banner and the Your Privacy Choices panel show that the signal was honored. If you had previously allowed a tool, the signal takes precedence; you can still switch a tool on yourself from Your Privacy Choices.

10. Do California residents have specific privacy rights?

In Short: Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

CCPA Privacy Notice

The California Code of Regulations defines a “resident” as:

(1) every individual who is in the State of California for other than a temporary or transitory purpose and

(2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose

All other individuals are defined as “non-residents.”

If this definition of “resident” applies to you, we must adhere to certain rights and obligations regarding your personal information.

What categories of personal information do we collect?

We have collected the following categories of personal information in the past twelve (12) months:

We collect this information directly from you, automatically from your device when you use our Website, and from ZoomInfo, which tells us which company a visit may come from.

We may also collect other personal information outside of these categories instances where you interact with us in-person, online, or by phone or mail in the context of:

• Receiving help through our customer support channels;
• Participation in customer surveys; and
• Facilitation in the delivery of our Services and to respond to your inquiries.

How do we use and share your personal information?

More information about our data collection and sharing practices can be found in this privacy notice. How long we keep each category is explained in section 5.

If you are using an authorized agent to exercise your right to opt-out we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf. In the preceding 12 months, we have disclosed identifiers, internet or other similar network activity, geolocation data, and professional or employment-related information to service providers for business purposes, such as hosting our Website and its forms and measuring traffic.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your personal data.

Selling and sharing. In the preceding 12 months, the ZoomInfo tag on our Website has received identifiers (such as your IP address and a cookie identifier) and internet activity (the pages you viewed) from visitors who had not opted out. Because ZoomInfo may use this information for its own purposes, including online advertising, California law may treat this as “selling” or “sharing” personal information, and we treat it that way. The category of third party involved is a business-information provider (ZoomInfo). We do not otherwise sell or share personal information, and we do not knowingly sell or share the personal information of consumers under 16 years of age.

Your right to opt out of selling and sharing. You can opt out at any time: click Your Privacy Choices in the footer of any page and switch ZoomInfo off (or choose Opt out of all), send a Global Privacy Control signal from your browser, or email us at info@thepowerscompany.com. We act on opt-out requests as soon as feasibly possible, and no later than 15 business days after we receive them.

We do not use or disclose sensitive personal information for any purpose that would give you the right to limit its use.

Your rights with respect to your personal data

Right to request deletion of the data (Request to delete)

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Right to be informed (Request to know)

Depending on the circumstances, you have a right to know:

• whether we collect and use your personal information;
• the categories of personal information that we collect;
• the purposes for which the collected personal information is used;
• whether we sell your personal information to third parties;
• the categories of personal information that we sold or disclosed for a business purpose;
• the categories of third parties to whom the personal information was sold or disclosed for a business purpose; and
• the business or commercial purpose for collecting or selling personal information.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to correct inaccurate information (Request to correct)

You can ask us to correct inaccurate personal information that we hold about you. We will use commercially reasonable efforts to correct it.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

We will not discriminate against you if you exercise your privacy rights.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other privacy rights

• you may object to the processing of your personal data.
• you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data.
• you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
• you may request to opt-out from future selling or sharing of your personal information to third parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 business days from the date of the request submission.
